Witness this rental contract made this ____ day of____________, 20____ by and between Portsmouth Live Events (hereinafter “PLE”) and _______________________________________

Whereas Lessee wishes to rent from Portsmouth Live Events located 6217B Portsmouth Blvd Portsmouth, Va 23701 (hereinafter ”premises”) and PLE is willing to do so under the following terms and conditions. 

THEREFORE, the parties acknowledge and agree as follows:

1). The Date & Day of Week of Event is_______________________________________.

2). Expected Number in attendance & type of Event ____________________________________.

3). Lessee shall pay to PLE a Security Deposit in the amount of _____________________, no later than contract signing. 

4). In return for the use of the premises, Lessee shall pay to PLE _____________as and for rental. The shall be paid in full no later than 60 days prior to event. 

5). The rental period shall begin on _____________ at ________ am/pm and the rental period shall end on ______________ at __________am/pm which time period shall include setup and cleanup. 

6). This contract shall not take effect and any event dates discussed shall not be reserved or confirmed until the Security Deposit is paid in full. 

7). The rental must be paid in full at least 60 days prior to the scheduled event or the event will not take place and this contract will be cancelled. 

8). Lessee shall indemnify and hold PLE harmless from all injury, claim, or loss of any kind arising out of Lessee’s use of the premises.

9). Lessee shall, at least 60 days in advance of the rental period, provide to PLE a certificate of insurance for a commercial general liability insurance policy, issued by an insurer authorized to do business in Virginia, with policy limits of at least 1,000,000.00 for bodily injury or property damage from any one occurrence and which names PLE as an additional insured.

10). Lessee shall obtain, at least 60 days in advance at its own cost all FIRE, ABC and Use permits required by law and shall provide these to PLE

in advance or the event shall not take place. 

11). The rent and security deposit is non-refundable and will be retained as liquidated damages if the event is canceled by the Lessee within 60 days prior to event is cancelled by PLE due to non compliance by Lessee with any of the requirements herein. 

12). Lessee shall be responsible for any damage done to the premises or its contents. 

13). Security Deposit be refunded within 7-10 Business days after the event so long as the premises are returned at the end of the rental period in the same conditions as they were received at the beginning of the rental period. 

14). The building Manager or his designee shall inspect and approve the condition of the premises immediately at the end of the rental period in the same condition as they were received at the beginning of the rental period. 

15). Any entrance upon the premises by Lessee prior to rental period must be agreed upon between the building Manager and Lessee in advance with the Building Manager having the final say so.

16). Lessee specifically agrees to comply with and abide by the currently existing premises Rules and Clean Up List and may obtain said list from the Building Manager.

17). There is ABSOLUTELY NO SMOKING in the building.

18). No nails, tacks, tape, adhesives of any kind on the walls or ceilings.

19). No alcohol of any kind may be brought on the premises unless the proper permit is obtained from the Virginia Alcoholic Beverage Control Board and is presented to PLE in advance of the event.

20). Lessee specifically understands and agrees that a violation of any kind of the provisions contained herein shall result in the immediate cancellation of the Lessee’s event, even it has begun.

21). Lessee is solely responsible for the setup and take down of table and chairs, cleanup premises, and all table and chairs shall be taken down and stored prior to the end of the rental.

22). Lessee shall hire PLE security company, with any event involving alcohol.

24). In the event of inclement weather (where a state of emergency or road conditions unable you to drive safely, refunds are unavailable but you will be able to choose an available date.

25). In the event PLE has to initiate any legal action to enforce any provision of this contract , Lessees shall be responsible for all cost and expenses, including but not limited to all attorney’s fees, incurred by PLE. 

26). This writing encompasses the entire agreement of the parties. (Exception attached cleaning check list) No changes or modifications will be effective unless they are in writing and are signed by both parties hereto.

27). The Property Managers are Kevin Cross 757-929-1612 and Tracy Cross 757-214-1956.

28). This contract is not assignable by Lessee without the prior written consent of PLE and the time is of the essence as to all provisions herein.

29). This contract has been entered into by the parties in the city of Portsmouth, Virginia and shall be construed according to the laws of the Commonwealth of Virginia.
